Recently, YiJu and Sunshine IP jointly represented the petitioner, EverPro Technologies Company Limited, in successfully closing the invalidation of two invention patents vs. Cosemi Technologies, Inc. The State Intellectual Property Office issued Invalidation Decisions No.51065 and No.51066, declaring that two invention patents of the identical name "Hybrid electro-optical data communication cable with wired capacitance compensation" (ZL201810201034.5 and ZL 201480038089.9) were invalid in their entirety.
The key to the said case lies in the accurate understanding of technical scheme and the organization and application of evidence. The claims of the patent in question involved multiple signal processing methods. We represented the invalidation petitioner and submitted several pieces of evidence which corroborated each other, and fully explained to the collegial panel that these multiple signal processing methods were either disclosed by the prior art evidence, or were in the public domain in the industry, and did not make any contribution to the prior art. In the end, the collegial panel adopted our opinion and affirmed that none of the claims was of novelty or originality, and invalidated the patent right in its entirety on this basis.
